1) Scope of Application
These General Terms and Conditions (GTC) of the company Versand-Agentur Herschel GmbH (hereinafter referred to as "Seller”) shall apply to all contracts concluded between a consumer or a trader (hereinafter referred to as "Client") and the Seller relating to all goods presented by the Seller on the electronic trading platform Amazon Marketplace of Amazon Amazon Services LLC and/or its affiliates (hereinafter referred to as "Amazon"). Reference is made to the Conditions of Use of Amazon.com Amazon Services LLC and/or its affiliates. The inclusion of the Client's own conditions is herewith objected to, unless other terms have been stipulated.
2) Conclusion of the Contract
2.1
The product descriptions displayed by the Seller on the Amazon platform do not constitute binding offers on the part of the Seller, but merely serve the purpose of submitting a binding offer by the Client.
2.2
The Client can place an order via the Amazon integrated basket system or via the 1-Click ordering function.
2.3
Immediately after submitting his order, Amazon will send the Client an e-mail confirming the Seller's receipt of the order. The Seller can accept the Client's offer within five days,
by transferring a written order confirmation or an order confirmation in written form (fax or e-mail) or by doing so through Amazon; insofar receipt of order confirmation by the Client is decisive, or
by delivering ordered goods to the Client or through Amazon; insofar receipt of goods by the Client is decisive, or
by requesting the Client directly or through Amazon to pay after he placed his order
Provided that several of the aforementioned alternatives apply, the contract shall be concluded at the time when one of the aforementioned alternatives firstly occurs. Should the Seller not accept the Client’s offer within the aforementioned period of time, this shall be deemed as rejecting the offer with the effect that the Client is no longer bound by his statement of intent.
2.4
The time limit begins to run the day after the Client has submitted his offer and ends on the expiry of the fifth day following the submission of the offer.
2.5
The English language is exclusively available for the conclusion of the contract.
3) Return Policy
3.1
Items can in principle be returned within 30 days after receipt of the item.The Seller pays for return shipping costs to his delivery address.
3.2
The Seller follows the Amazon.com policy regarding items, which cannot be returned. In addition, the Seller does not accept returns of the following items.
Goods, for which the price is dependent on fluctuations in the financial market which cannot be controlled by the Seller;
Goods that are made to the Client’s specifications or are clearly personalised;
Goods which are liable to deteriorate or expire rapidly;
Newspapers, periodicals or magazines
Sealed goods which are not suitable for return due to health protection or hygiene reasons, if they become unsealed after delivery;
Sealed audio or sealed video recordings or sealed computer software, if the goods become unsealed after delivery.
3.3
The Seller answers to a return request within two business days. When returning items, the Client is asked to follow the return procedure set out in the Seller’s Online Return Center with Amazon.com.
3.4
The Seller refunds the Client the purchase price once the Seller has received the item sent back to him. If Items are damaged, parts are missing, are not in the original conditions, or have obvious signs of use for reasons not due the Seller’s error; the refund will be reduced to 50% of the item’s price.
4) Price and delivery costs
4.1
Prices indicated are indicated in US dollars excluding taxes and shipping costs. Shipping costs are specified separately in the respective product description.
4.2
For deliveries to the United States, additional costs may arise such as transfer fees charged by the bank and taxes and/or customs duties. Those costs have to be borne by the Client.
4.3
Payment can be processed via the Amazon payments system of Amazon as platform provider. Payments can be made by debiting the account (direct debit), or by using a credit or debit card (Visa, Mastercard, American Express).
5) Shipment and Delivery Conditions
5.1
Delivery of goods shall be made on the dispatch route to the delivery address indicated by the Client, unless otherwise agreed upon. The processing of the transaction is based on the delivery address provided by the Client to Amazon.
5.2
Should delivery to the Client not be possible, the assigned transport company returns the goods to the Seller and the Client bears the cost for the unsuccessful dispatch. This shall not apply if the Client is not responsible for the event that entails the impossibility of delivery, or if he/she has been temporarily impeded to receive the ordered goods, unless the Seller has given notice to the Client in an adequate period of time prior to the delivery.
6) Warranty
The Amazon A-to-z Guarantee Policy applies to Client’s claims, if
the Seller fails to deliver the items within the maximum estimated delivery date displayed on his order detail page or in his order confirmation e-mail,
the item was defective, damaged, or not the item depicted in the Seller’s description,
the Seller does not accept the return of item in accordance with the return policy depicted on his own website.
the Seller has charged an amount greater than the amount authorized by the Client for his purchase,
the Client returned the item to the Seller by mutual agreement and the Seller has not provided the agreed upon reimbursement after receiving the item.
When filing a claim the Client has to follow the procedure described in the Amazon A-to-z Guarantee Policy.
A replacement of items is not possible, if the item was defective, damaged, or not the item depicted in the Seller’s description.
7) Law and jurisdiction
The Federal Arbitration Act, applicable federal law, and the laws of the state of Washington, without regard to principles of conflict of laws, will govern these General Terms and Conditions and any dispute of any sort that might arise between the parties.
8) Privacy policy
8.1
Personal data will only be collected, if the Client provides this information on his accord for the processing of a contract or when registering for a newsletter. Those data will only be used for the processing of a contract and for Client’s inquiries.
8.2
After full implementation of the contract and complete purchase price payment, the Client’s data will be stored on account of the preservation period in accordance with tax and commerce laws. Upon expiry of such period those data will be deleted, unless the Client has expressly consented to the further use of his data.
8.3
The Client has a right to get information free of charge about his stored data and, if he so wishes, he has the right to correction, blocking or deletion of those data. For questions regarding the collection, processing or use of his personal data he can turn to the Seller, free of charge.
